Inadvertently Poached Pre-Order

So we may have inadvertently poached someone's pre-order. The dealer goofed and thought that the customer had cancelled the pre-order so they sold us the car. We did finance paperwork and paid BIG down-payment, and were told we'd get the car when it's delivered 03/01-ish. Dealer called on Sunday to say that the pre-order was still wanted, and they would have "do something" and he'd have to chat with his manager and call me back. Found out today that they cashed the down-payment check, and we've already given that VIN to our insurance and stuff. What happens here? Do they find me another Mach-E or the O.G. orderer?

Uhhh, You shouldn't have signed anything or given money (except for a deposit) until they have the car on the Lot. They can't sell you a car they don't even have yet....

Very surprised with the deal... they don’t do contracts without car being on the lot. My insurance kept asking for mileage to do the binder.

Found out today that they cashed the down-payment check, and we've already given that VIN to our insurance and stuff. What happens here? Do they find me another Mach-E or the O.G. orderer?
They refund you the down-payment, and you remove the VIN from your insurance. You'll have to find one that's actually available or place a new order at this point.

If you are willing to wait, see if they will give you a discount off MSRP for when one comes in that you can have. If you are not, see if you can find another Mach-E somewhere else and make them pay for any difference in cost you will be incurring by going with another dealer.

Pretty much anywhere, I would guess this amounts to breach of contract on their end. But give them a chance to make it right, they probably know they messed up.

Thanks for all of the responses! It's been a decade since we last bought a car, so I'm not even sure what is "normal" these days. I have confidence that the dealership will make it right, but I wasn't sure what that looked like. Thanks again and l will post updates when I hear back.

Yeah it shouldn't be difficult to remove the car from insurance. The biggest thing is to get your money back from the dealer and hopefully they will make good to you with first dibs on the next available...

Amazing. I’ve never heard of a dealer taking a down payment or a contract without the car on the lot. Heck of a situation you find yourself in. Hopefully the dealer makes it right - plus a little extra.

Most likely scenario is that write you a check back for the money, they apologize profusely and they try to somehow keep you as a customer.

So, interim update - I left a message for the sales manager this morning, but hadn't heard back from him by 4pm, so I asked my hubs (a.k.a. "The Switch") to call back. He gets the sales manager on the phone, talks to him for a bit and apparently he "has a sure-thing FE in the same color that he can get for $4k more, but will give us $1k off that for our inconvenience" hubs agreed to the upcharge because he knows I want this. Sales manager said he will call back in a few minutes. That was 4 hours, ago and they close at 9p. I'm not feeling the warm and fuzzies on this deal at this point, but I'm honestly curious as to where it will go... "The Switch" is snoring gently on the couch next to me, so more updates tomorrow.
