to add to this: I'd consider lodging a complaint with your State Attorney General. The new owner buys the contracts as-is, refunding your deposit sounds a bit like they wanted to break your original order agreement without ADM to then add the upcharge.
I'm going to say it seemed to be, because it looked like it would let me go through all the steps.
But since I stopped at having my credit run and had the info sent to the dealer to complete the deal, I haven't gone back to see if it will let me continue with purchase completely online.
This is my experience so far, too. Got the call that my Mach E had arrived this past Saturday. I wasn't able to go in to see it until Monday, which is when it took about 30 seconds of talking to the finance or business manager to get me really worked up about how much I do not like car dealers...
Any dealer doing that should be put out of business.

I doubt the dealer forgot about the tax credit. Based on the reports that dealers are marking up new ones, this dealer figures they could still get someone to buy for something north of $46K, as compared to a new one with ADM subtracting for the tax credit.
Well, I doubt the OP is going to accept an of $36.5K since they already have an offer for $44K.
However -- and this is pure speculation on my part -- maybe the reason for posting here is they'll accept a little bit less than $44K from someone on this site (a sort of "friends" discount)...
Also, one more thought on this particular dealer. When I went to check out the MME I had ordered, there were two other MMEs on the lot. I was under the impression from my previous dealings with this dealer and that they were on the "no ADM" list on this site, but the other MMEs had ADM...
