Possible the lame duck session would try to pass this, after the election but before inaugurations. I personally like the idea of a phase-in as opposed to the slam-in the way the law is currently written.

But the reality is, very little can get past the 60-vote Senatorial Procedural Filibuster, and it takes a lot of machinations for bills to get exempted from it. Those bullets are mostly spent and if they have one left, this isn't going to be a priority to use it. Only way it would happen is if it was a rider on a new budget, which they have to pass in December (which is possible).

Possible, yes, but I wouldn't count on it.

Right. I thought your statement was completely pragmatic. I also agree. No political slant at all, it just is what it is in terms of the legislative process.
