Sunnyvale Ford sold my Mach-E

I put a $500 deposit at Sunnyvale Ford back in March on the exact MME I wanted, Premium AWD Extended range, Star White with Space White gray interior. The vehicle tracker told me it was delivered on May 25 so I emailed them on the 26th about its status. Today I was informed it was sold to another customer immediately after it rolled off the delivery truck. All I get from Sunnyvale, from General Manager to three sales people, is "we're sorry". The salesman I was working with, Sagar, has been extremely helpful but he is out sick this week, so even he is a loser along with me in this debacle.
It is extremely rare for me to get mad (except with my wife) and this pushed me over the edge. Sunnyvale Ford has no doubt how I feel. Their offer of "we can order you another one" didn't go over well.

I have been in this forum since January and ordered my car in December. I am waiting for delivery which should be soon. I am leaving on a three week vacation soon and now I am beginning to wonder if something similar will happen. it seems as though the dealer stories just get worse and worse.

If it's any consolation, my order is supposed to arrive in the next two weeks. If you want it, you can have it. I bought a canceled order off a lot two months ago and won't be picking my order up. Folsom Lake Ford. If you're interested send me a message and I'll hook you up with my salesman.

Have you contacted @Ford Motor Company? Executive e-mail addresses can be found here: https://www.elliott.org/company-contacts/ford/ You may have some luck contacting Ford via Twitter or FB also. This has to be the shittiest deal I've heard about so far. Did you place the order through Ford.com and have all the documentation there?

Unfortunately like the C8 Vettes , dealers can do this and break a contract. Even if you place a deposit. They violated a agreement but only enforceable by a judge in court. The law is you can go to court but you have to pay your own legal fees and they pay their own. The law does not allow the verdict to pay the winners legal expenses. They will be more than the damages you experienced. Bad dealers capitalize on this. It sucks. They should return your deposit. Money is why they do it. I would slam them on Social media and call a local news crew. They deserve the bad press. They sold it over MSRP to them. This argument was covered on YouTube by Leato’s Law a while back.

Yup! I too have a couple of leads I'm working to get my Mach-E early. I fully expect neither one to pan out despite dealer assurances. They are not fools and know what they can get away with. Resigned to waiting right now.

And yet another car fails to hit the second hand market.

This is why I always keep a couple of spare cars. ;)

Looks like there is one exactly like you want it at Scarsdale Ford in New York - though looks like a customer order from the window sticker, but you never know, person might have backed out. If you don’t want to do a cross country road trip, I think dealers can arrange shipping for several hundred dollars from what I have heard.

Same story for this one at Bob Davidson Ford in Maryland, but the window sticker doesn’t say special order like I think it would if it was a customer order so maybe either a dealer demo or just one for them to sell off the lot?

This is terrible. Are they at least going to give you back your deposit?

That was a completely shitty thing for them to do.did the paperwork for the deposit list the vin number, or was it a “we have one just like that
coming in soon, do you want it?” kind of thing? Like do you have any hard evidence that you put the deposit on that exact car, or can they say in court that you put money down on a car like that one? If you put a deposit on a particular vin, I would think you should be able to compel them to buy an identical one from another dealers lot, have it shipped, and fulfill your deal. But I don’t know the legalities of that. Also, I would put them on blast on every social media platform you engage in Until they make it right. And then I wouldn’t ever step foot in that dealership again.

Crappy thing to do, but there is nothing to sue them for if they return the deposit, since the OP is made whole at that point.
