My order is scheduled to be built, but I used deposit to buy one off the lot. Can I still get the new car at MSRP?

I ordered a Premium MME in July 2021 and paid $500 deposit. Then a few months later bought a similar car off the lot at the same dealership and the $500 deposit was used as part of the down-payment for that car. The dealership didn't cancel my order though, as I can still see it in my account. It is scheduled to be built this month (after two 1-week delays). Now my question is once it is ready and shipped, can I still get my ordered car at MSRP, given that I've already used the $500 deposit toward the purchase of the car I currently own? Is the dealership required at all to ask me if I want the car when it arrives?

No one on this forum can answer your question. You need to discuss this with your dealer (shocked that you didn't when you made your purchase). They will tell you if that order is still yours, or if your name has been removed. If it's still yours, then you should be able to buy it at the price you agreed upon when you ordered it.

I ordered mine on 5/29. On 7/2 I bought the exact same car off the lot. The dealer asked if I wanted to keep mine on order, and I said yes, and they retained the $500 deposit (they offered to return it, and I said sure, but they didn't). I will be getting it eventually, at the agreed upon price, and plan on selling my 2021, assuming the 2022 is perfect.

Thank you for your response. I was hoping to see if someone had a similar experience, but yes this is eventually something I need to ask the dealer.

My plan is exactly as yours (if this piece of the plan in question works out). The reason I didn't discuss this at that time with the dealer is that I didn't think the car I'm buying would actually appreciate in value over several months, so at the moment I really wasn't going to keep my order.
