Picking up Mach-E AWD order back in February this Saturday! However dealer said that Ford now requires all purchasers for electric vehicle to sign a one-year non sell contract. I thought that was just for F-150 and not applicable to Mach-E? Has anyone else been told or needed to sign this? If yes, just curious how enforceable is the contract. What if I lose job within a year and need money, I still not able to sell? What if I just want to transfer title to family member and not technically ā€˜selling’? Very strange consumer is getting forced into signing these contract when it was not there when I placed the order.

I just picked up my GTPE a couple of nights ago. My dealer didn’t make me sign anything like a non-sell agreement.

Maybe it's really meant for 22/23 conversion orders since there's a big price jump? With the new 23 price, Ford returns $6k, Feds $7500, State $2k that's $15500 I could profit with a quick sale just by selling at 23 MSRP.

Ford does NOT require this. They DID suggest to the dealers last year that they do this. You are NOT forced to sign it as you have the option to,not buy the car. Read the form to see circumstances that would allow you to sell. Likely it says dealer has first right to buy at preset price.

How enforceable is the contact? Who would even enforce it? How would they even know?

That said the IRS could enforce $7500 against you if you buy it with the intention of reselling it. They could enforce that through an audit.

I have not seen the actual agreement, but was told this applies to all electric car from Ford I'm just not comfortable signing something like this. I have every intention of going through with purchase for own use, but I can't predict if I might need money or not in the future given the current status of economy. Maybe it's a ploy to get customer to not take the car and dealer can turn around and add 20k ADM on top.

Ford is not requiring this, so your dealer is lying. That being said, they have all the leverage here so you may not have a choice if you want the car. You could ask them to see a document from Ford that states that this is required.

Thanks, that I will do. I'll also call Ford to see if such requirements exist. Really hate having to deal with dealers.

Already told you that there is no such requirement, Ford SUGGESTED it to dealers last year and provided them with rough wording, and told them to consult legal counsel and their own state laws.

Your dealer can REQUIRE you to sign it if they want to. You can CHOOSE to not sign it, and not buy the car. Again - I'd suggest reading the terms before deciding anything.

This is the notice sent to dealers earlier this year. As you can see, Ford said they would support a No-Sale Provision. That's very different from requiring it. And it's moot for the Mach-E anyway since this notice was specifically for the F-150 Lightning. But none of that means that the dealer can't do what they want to do. You likely will just have to take it or leave it.

Basically dealers ā€œmayā€ require it and Ford supports this.

For the OP, I would just sign it and buy.

This may be a dealer tactic to get you to walk away so they can sell your car at a huge profit to someone else.

Zero chance they could enforce this (unless you try to trade the car back to the same dealer, but even then they wouldn’t enforce it).

And even if they TRIED to enforce it…… what would they do? There’s no penalty outlined in the contract. Would they really waste time and $$ in court to try to put a ā€œstop saleā€ on your vehicle?

Just do what you do every time you see the ā€œterms and agreementsā€ on your phone. Check the box and move on.

I was going to say this too, it's optional for the F150 Lightning but there is no requirement for the Mach-E. So that's a dealer driven thing. You might bring a copy of that memo with you to point out it doesn't mention the Mach-E, and say that other dealers have no such requirement.

Thank you, I'll do that. This is total BS in my opinion.

Are you trying to use X-plan? There's a clause in the X-plan agreement that says you can't sell it within 6 months. I used X-plan with mine that I picked up on October 22nd and didn't have to sign anything. If no X-plan, I'm going to agree with everyone saying they're just trying to get you to walk away.

I don't have X-plan or any discount. Just straight purchase price with all the doc fees. I've voiced my concern to the dealership, and told them that I called Ford corporate and was told no such agreement exists. I'm picking it up tomorrow so we'll see how that goes. Maybe I'll threaten to escalate this up Ford corporate and/or give all 0s on the post purchase survey? Maybe that will get them to back off, I hope.
