If the statement is true in this video, about MME GTPE being hampered to just 5-seconds of full power, then GTPE won't ever win these kinds of tests.
For the liability concerns, "Track Mode" could cross-reference vehicle GPS location to make sure it isn't being used on the street (other cars do this).
For battery friendliness, "Track Mode" could allow "full power" for a longer duration, such as 60 seconds, but then impose a period of cooling before it can be used again. There could also be limits around SOC cannot fall below 20%, or something like that, which would probably be prudent for battery health.
