Yep, an I understand that. Except charging me that much to just punch my vin into a computer system and checking the faults is ridiculous
I do not disagree.

so the answer then, turn off the upates, so you don't get OTAs and you also don't get updates at the dealer? That doesn't sound like that great of an idea.
Sounds to me like an eminently sensible idea. Ford's software updates do more harm than good.

Do you have a regular service advisor? I’ll occasionally but then a Starbucks gift card or Panera etc. I had a few fees “waived” mysteriously. Just a thought
I do the same thing! and it works. The best part is, I like the guy.

Cars accepting OTAs and those OTA's possibly "breaking" a vehicle are, I think, a new legal area. Perhaps the OP should contact a lawyer...

An argument could be made (no idea if it could be won) that Ford broke the vehicle by transmitting faulty code to it.

I know people will say that a customer could have turned off OTAs, but the argument for that is that Ford could also stop SENDING OTAs after the vehicle is out of warranty and that by continuing to send OTAs, they are assuming responsibility for them.

All this could be presented using an analogy of a former employee of a company using their old employee credentials to log in their former employer's network and then locking files or doing something else destructive. In that situation the courts have already determined that the former employee could be held responsible....

(I'm not saying one way or another.. I'm just discussing both sides...)

This is exactly why I got extended warranty when I’ve never bought it before. Updates to my car happening all the time which is brand new to the car industry. An OTA already killed my bluecruise but was fixed under warranty.

(Replying to myself is always fun...)

I was thinking about this some more trying to come up with any kind of precedent. The closest I could come was the Apple iPhone. At one time, Apple sent firmware updates (OTA) to older iPhones that purposely slowed down the OS. These updates were always sent to phones that were outside the 1 year warranty... (google for "batterygate")

Eventually, Apple claimed that they did it purposely to help preserve the battery life of older phones (or some similar BS.)

After a class action lawsuit, Apple ended up settling and their payout was something around 500 million US dollars. That was just in the USA.

This wasn’t an OTA update though. This was a CSP done by the dealer and paid for by ford. While technically voluntary they send notices out just like a recall which implies somewhat of an urgency in getting it completed.
Ford has already admired that they caused the issue. Ford CS implied that they would cover the repair if the request came from the dealership but will absolutely not cover the diag fee (even though the paint CSP covers inspection). dealer won’t talk to ford unless they charge me over $200.

The solution is simple Ford stops skirting the issue and issues a CSP or instruct the dealer to skip the diag and do the upgrade paid for by ford.

I still think you would be well served by speaking to a lawyer. 99% of them will at least give you an initial consultation for free. Ford broke it, and Ford should cover all the costs to fix it, including the diagnostic fee if that fee is required as part of the fix.

I have had that same opinion every time a check engine light has came on an ICE vehicle for the last 20 years….

Got a couple free oil changed once out of complaining that non dealers generally don’t charge to pull the code…..but dealers love charging for it.

It sounds like I'm an oddball. I've had my mme for over a year and haven't been back at the dealer with any problems. You guys that know service techs by first name must have had some real problems. I'd rather not know the service techs.

This is a safety issue. You should report this to the feds and see if they can move Ford through a recall or forced action.
