I suggest calling a law firm that specializes in this sort of law in your state.

For many consumer facing issues, such as lemon law on cars, attorneys don't actually charge you anything upfront. Instead, if they think you have a case, they just get a cut of the settlement or, if it goes to trial, some portion of the recovery.

These types of law firms will therefore often talk to you for a little bit for free over the phone just to see if you a case that they would take on or not.
Reading through some online it seems pretty trivial to file the form.

My thought was file the form so that Ford might actually respond as they need to in 10 days and fix issues 15 days after that.

If I don't get response or fix then get a lawyer involved

Have you tried another dealer? I would do that before I went down the lemon law route. Also have you contacted Ford

Two things here:

1. Florida lemon law is written to cover only "defects or conditions that substantially impair the use, value or safety" of the new or demonstrator-purchased vehicle. Good arguable question whether lack of OTAs falls under this provision, sounds like it probably would since there are major features and functionality that's impaired here (such as recall OTAs, improved UI, no BlueCruise etc etc). 2. Before contacting a lawyer, I would call the Ford BEV team and initiate a buyback request with them. If you're not getting anywhere with them, I would investigate contacting the BBB Auto Line, which is a mediation service that works with the manufacturer if the car is eligible for lemon status in your state. A friend had good results from this with a different car brand. I might start with Ford, however, and see if they will initiate the process.

I saw your other post in the 1.7.1 stuck thread. IMO I would still be happy being stuck on 1.7.1 rather than driving something other than my Mach-E on a permanent basis, but I recognize that everyone's situation is different. You might want to try a different dealership if that's an option for you. The first one I went to to fix the 1.7.1 issue was able to get that part resolved, but I had to spend another 3 weeks in the shop at another dealership to get Bluecruise functional.
Did you have 1.7.1 and remember the way the car behaved? It would be a prob for most when the car acts up and your still on 1.7.1. I believe he should be entitled to come along with the rest.

Definitely will substantially impair the value over time if he is stuck on crappy 1.7.1 forever. Part of this cars value as sold as improvements via OTA. Future proofing and does have value.

I haven't tried another dealer, the one I've been taking it to is EV certified and most convenient for me.

I have contacted Ford numerous times and they haven't been much help.

You need to get to the BEV team, and to say you want a buy back initiated.
