My understanding was the deposit was non refundable
Fine print on Ford website says deposit is up to dealer's refund policy. If they told you it was non-refundable AND you signed something saying that then I think you have your answer.

Lots of Ford dealers around Indy. I'd look for one that promises refundable deposit. Frankly, they should be happy to get their hands on a canceled Mach-E that they get to sell to someone else (usually at a mark-up price that way). If you're current dealer refuses to budge on committing to deposit refund, just tell them "Oh well, I'll just keep trying other dealers around town". They may magically change their mind at that point.

Personally, I think I'd just order the AWD if you can get refundable deposit committment. My guess is the bill will never pass. And even if it does, it'll probably have the $80k cap.

If the bill doesn't pass, existing policy stays in place. Ford is probably due to use up their 200,000 quota around the middle of 2022.

Ford classifies it as SUV on their website.
If the classification for tax purposes was allowed to determined by the manufacturer, every BEV will be an SUV! ?

According to the "bearded tesla guy", the machE is classified as others/car instead of SUV.

Order the car you want.

Find a normal dealer with a refundable deposit.

You can always change your order should the credits and price not move in your favor.

The dealer told me in writing it is non-refundable if I do not take delivery of the car. Am I missing something?
For a variety of reasons, I have two on order. One placed at the dealer with no deposit and the other placed online with a refundable deposit. Most dealers I’ve spoken with in FL are more than happy to place your order and actually want you to bail. This way they can get the car and mark it up to someone else when it arrives.

Unfortunately the EPA classifies it as a small station wagon and the BBB proposed legislation says Treasury should follow EPA guidelines.

I am sure Ford lobbyists are going to try to get it changed. Hopefully they succeed.

Thanks for asking this. I’m in exactly the same boat. Ordered a Premium Ext Range AWD MME just a few weeks ago; realized today it may not qualify for a tax credit if the new law passes as written currently. MSRP is over 55K and EPA classifies this as a wagon, not an SUV (unlike the Model Y which somehow receives an SUV designation). Kind of hilarious to me, given how anti-Tesla this administration clearly is, that this legislation will push a lot of people away from MME and towards Model Y - if it passes as written and designations / caps stay the same. Premium AWD Ext range MME is the closest comparison to LR Model Y imo.
