Sounds like you probably shouldn't do your own updates since you're concerned about it. But to answer your question, yes I've had warranty work done after doing updates.You can use it for other purposes like problem investigation, and/or updates for cars outside their warranty window. I don't see the argument that they sold you a software license for FDRS as authorizing you to update the car.
