After purchasing my new Mach E premium from the dealership they wont let me take the car home.

After completing the purchase of my 22 MME preminm the dealer informed me that I could not take the car home. Ford just issued a recall that involves the HV battery contactors that force the dealer to not release the car until the recall is completed. So after waiting 36 weeks for the car I now have to wait for this issue to be resolved. Bummer.

Is that contract enforceable? Seems odd you could sign a contract saying they’re selling you the car but the recall specifically says they can’t sell cars, not just don’t give them to the customer. It would seem if they actually sent the paperwork to Ford saying the car was sold, they’d tell them they’re about to get fined. Hopefully OP digs in further and gets it voided. You’d be out of your mind to be making payments on a car you never even drove.

The delivery hold recall is Safety Recall 22S41. Says the dealer bulletin won't be available until 3rd quarter of 22. So the earliest I could get the car is in July. This is a major hiccup by ford. They better get busy at solving this fiasco. Until then I sit here paying payments on a car I do not have. The only reason I completed the purchase was to prevent the dealer from selling the car to someone else like was reported elsewhere in this forum

We are literally going through a buyback process right now and my replacement is sitting at the dealership. My husband has talked to the Ford buyback representative several times today and nothing has been said about any of this. We’ve already secured financing and don’t want to lose the interest rate, much less be out of a car either way. This is just crazy bad timing. ??‍♀

Please read posts in your thread. They CANNOT sell the car during a sales hold. Read the notice. You need to talk to your dealer, if they didn’t allow you to take delivery, your sales contract is void since the stop sale prohibits them from selling a car. If they actually attempt to “complete” the sale, once they submit the paperwork to Ford, they’ll be fine $21,000. Doubt you paid a markup like that.

You need to talk to your dealer, if they didn’t allow you to take delivery, your sales contract is void since the stop sale prohibits them from selling a car. If they actually attempt to “complete” the sale, once they submit the paperwork to Ford, they’ll be fine $21,000. Doubt you paid a markup like that.

Which is essentially the same thing in this case. “However, it is illegal for dealerships to sell new vehicles that are subject to recalls without first repairing them.”
They can sell used cars with open recalls, but it is illegal for them to sell a new car with an open recall.

It’s interesting but I believe the recall is not yet “open” under the law. Once it is they cannot sell new cars without completing the recall.
I think the notice today prevents legal liability for Ford if a car is delivered with a known safety defect.

However I cannot see how a dealer would be able to sell you the car but not deliver it and be able to complete the contract. I think they have to void the sale with you as they are not able to perform under the contract.

You’re right, they can and will sell the car. It’s not against the law or Ford’s rules. They just can’t deliver it or let customers drive it, like you said. I went through the exact same thing with the roof recall. Got mine right before I made the first payment. Good luck, hopefully they get it to you quickly.

That would make sense. I can’t see how anyone would agree to a contract if they won’t give them the car and you have to make payments for who knows how long.
