Handling a fraudulent insurance claim against Mach E

This is a unique situation so I thought I will get some advice from here.

Someone in South Cal reported that our Mach E hit their car - that the driver of Mach E fell asleep and hit their unoccupied car. They even filed a police report (which our insurance is in the process of getting a copy of). The fact is we live in Nor cal (Bay Area) and this vehicle has never been out of Bay Area. In fact on the day of the alleged incident our app shows that Mach E was getting charged at our home in the Bay Area. I have sent the video of me walking through the Mach E app and showing all the right screens which shows that at the time of incident Mach E was getting charged at our home in the Bay Area to our insurance adjuster. The adjuster is yet to get back to me. And we are yet to see the police report.

Is there anything else I should be doing at this point? Is there any way apart from the charging history to show that the vehicle was located in Bay Area at that time? Are there any screens in FordPass app that shows that? Has anyone encountered anything similar (a fraudulent insurance claim like this) before? How did that go?

I would think it must be either mistaken identity or a scam of some kind. They couldn't possibly hope to succeed on an insurance claim with all the physical evidence disproving your involvement - e.g., your car does not show accident damage or recent repair of accident damage. They must be planning something else. Is the "adjuster" from your company? Are you sure?

Sounds crazy.

They’re hoping that your insurance company will settle for nuisance vale (and recoup it through higher premiums) versus spend money to litigate. And your ins company might even do it.

An easy way to stop them is to sue them for defamation. They are falsely accusing you of a crime, which is per se defamatory. Hire an attorney to take the defamation case on a contingency basis (no cost to you). Then agree to drop it only if they drop their fraudulent auto claim.

How many days or weeks after this supposed incident did you find out all this started going on? Because I was gonna say if this was like within a day or three of the incident I would’ve called a cop to come out take a look at my car and verify zero damage And pretty much go from there that there’s no way this could be me because there would be obvious damage unless they’re talking about just a scratch

You’re doing all you can right now. Let the insurance company do what you pay them for. I would not personally sue the fraudsters. I would tell the state attorney general and state insurance regulator. You’re also paying them to fight for you. They may not do something for your particular case but they should hear from victims of crimes. You could consider excess insurance aka umbrella policy if you have wealth you can’t afford to lose to unscrupulous personal injury lawsuits.

How many days or weeks after this supposed incident did you find out all this started going on? Because I was gonna say if this was like within a day or three of the incident I would’ve called a cop to come out take a look at my car and verify zero damage And pretty much go from there that there’s no way this could be me because there would be obvious damage unless they’re talking about just a scratch
Well, the claim was filed around 9/23, but the date of incident is marked as 9/8.

Good point. I am not planning to sue them, as long as my insurance adjuster acts reasonably. I like the idea of letting the state attorney general and state insurance regulator office know about it.

I do have ring cameras outside the garage which would show the car going in the garage and coming out of it. I am sure I can pull recordings of the car going in my garage the evening before the incident, and coming out of it the morning after the incident time. Thanks!

The adjuster is from my insurance company. She has all the reasons to work with me on this. Right now they are like the claimant is saying one thing and i am saying another, and what is the course of action in such a case. So they are waiting for a copy of the police report, and I am giving them a proof that the vehicle was being charged in my garage in the Bay Area that night. She has to process all that and go from there.

Well, it seems like you should be fine then, just a nuisance to do the paperwork. How did they even identify your car as the hit-and-run vehicle with the sleepy driver? Wrote down your license plate number as you supposedly woke up and sped away into the night? Obviously, they can't have a photo, as any real victim would have tried to get.

Just crazy.

that's incredible, do you think it could be a scam? Surely if a police report exists, it'll show the claim to be BS, unless by some weird quirk the cop entered the wrong plate number on the report. Just don't see how this could have any legs at all.

We will know more once we see the police report. Right now I am guessing the cop entered the wrong number plate somehow. Let's see.
