Driving Vehicle While Waiting For Service

I'm waiting for a decision on my buyback for a 2023 Mach-E Select that has third HVBJB failure. I'm at the dealership now for my appointment to get the diagnostics done so I can have it on record.

I was told their only "EV tech" is backed up until next year (mid-Jan 2024) and their service center was wrong to make today's appointment. They are also out of loaner vehicles.

My question is, do the days waiting to be seen next year after bringing it in count as "being in for repairs" as per lemon laws requirement of being in for repairs for more than 30 days?

Furthermore, if I just leave it with Ford when does the clock start? At time of drop-off or when the service finally begins?

If a loaner was available I'd take it. As it is I can still charge at home but can't really do any driving except to and from work.

The dealer has to have your car, find another dealer that will take it in sooner. You can't obviously force a dealer to take it, unless it is not driveable and you have it towed there, they'll usually store it until it can get seen. Rarely they'll tell you it has to be towed elsewhere.

I really would have just pushed with the service manager or director on getting seen today. It doesn't take much for them to just hook it up and pull codes to confirm it is the HVBJB that failed, especially if you explain what is going on and if they're the ones who have done the other replacements.

They don't need to have it to see the codes...

I am only guessing here.... but since we seem to be kindred spirits in similar situations...

If your car says "Stop safely now", I would consider that as the countdown time for a lemon law. I would also leave it at the dealer unless they can clear the code and it doesn't come back.

Just today, I had to go into full nuclear asshole "squeaky wheel" mode with the BEV team, the dealer that sold me the CR1, and the service manager at the dealer where the car has been waiting for the unavailable part, to finally get my charging port assembly found at another dealer in CT (I'm in WA) and "emergency ordered". After two weeks of no car, Ford and the service department finally worked out a way to get me a rental car too (still waiting for the call back with information on that).

You have to be "that guy" and advocate for yourself. It's not my comfort zone, but it's seems to be the only way to get things to happen. You clearly have a valid case with 3 HVBJB's. All of the cumulative time that you have spent on repairs should count towards the lemon law and buyback.
