Pines Ford refusing to honor X-plan

All I have is the original online order. That shows the markup of $2k. I posted on here after that and followed advice to get the x-plan through mcoa membership.
why is there a mark up of 2,000. did you agree to that and sign that its ok?

That’s the dealership. I’ve been dealing with Jorge Villanueva in sales and the manager with the last name Clark. But it seems that the real issue is with the dealership owner, Juan Malo.

1 did you place the order online with ford or at the dealer?
2 what paperwork did you sign if any and can i see it pls?
3. what is the total price the mache was offered to you for?

Most of the South Florida dealers have been showing thousands in markup ever since orders originally opened in June. It's the same region the EV Bite guys are from and probably the main basis of their originally reporting about ADM on Mustang Mach-Es.

I am not surprised by any of this. :(

Your dealer probably showed the $2k markup at the time you ordered and if you accepted that without first getting in-writing confirmation of their x-plan acceptance, you might be stuck with either accepting the price as was offered or walking away from it, potentially without your deposit.

There are a few dealers in your area showing no markup on online orders. I don't remember which ones but I'd found at least two when I checked each one of them on ford.com way back when. Probably one closer to Miami and one closer to West Palm Beach.

I went through the reservation process and discovered that my dealer is adding a mark up to the car.
I placed my reservation with the $500 deposit. When the 'reservation' was converted to an 'order' a form came up that showed my my contracted price to buy the car from the dealer (this was end of June).

THAT price is THE price. The dealer would have accepted your deposit with an agreement to sell at that price. It is my understanding that they have a contract with you to sell at that price. If they accepted your deposit and placed the order ... I don't believe they can back out. While I am not a lawyer, I do recall learning contract law ... offer, acceptance, terms & consideration ... an offer was made, accepted, and 'consideration' is that you put money down and they accepted the money. They're locked in.

I'm pretty confident the dealer CAN NOT legally raise the price (you'll win that fight) *because* they accepted the deposit.

That doesn't get you X-plan ... that just gets you MSRP.

When I went through this with my dealer we did have a discussion that I wanted to use X-plan and my dealer does X-plan ... so it was a non-issue.

Sorry you are dealing with an unscrupulous dealer.

I'd suggest you remind the dealer of the fact that they accepted a deposit that legally binds them to that price. I'd also suggest you contact Ford and report them.

Alternatives:

There's a dealer in my area (Michigan) that has the Grabber Blue First Edition at MSRP. I tried a few zip codes in Florida and didn't find one... but then I tried Atlanta, GA ... and DID find the car.

(Not sure if that really long URL will work for you. It's listed at Allan Vigil Ford In Atlanta, GA. So ... a little bit of a drive from Florida's if you want to get it ... but at least you can get one.)

To find the car I just went to Ford.com, scrolled to the bottom of the main page and in the dark gray box there's a "Search InventorY" link. You pick some filters to narrow it down to electric cars, pick the Mach-E, and then a search radius, and then "Search Inventory" again .... and it will show you the inventory of all the dealers near you.

The crazy thing is I have a vid of your car in my phone. Your car was unloaded from a train at my job. I’m a freight train engineer btw. It was the first one I saw in person. It had a sticker that said pines Ford on it.

After reading all of this. I’m not looking forward to dealing with Pines Ford. My Mach-e was just built this week and expected to be here next month ugh. Will definitely let them know I’ll never do business with them again. Really wish I would’ve known sooner.

It was added at the time of the online order and was the dealer markup. When I found out that this was not standard and that other dealers are not imposing this fee, it was already too late to switch dealers. So, I got the x-plan. The dealer didn’t like that.

Me too. And almost every other dealer in the area is not imposing this fee. And, really, would’ve blindly paid it if I didn’t have such great advice from this forum.

You’re right. This did show up at the time of the online order, but that was standard and there was no way to add the option of x-plan. I chose this dealer because it was the closest. at that time, there was no information about mark up. The process was so much like that of Tesla. I don’t buy a lot of cars, so this “fee” hit me like a ton of bricks when I found out. Especially when you consider that if I had scrolled to the next dealer (automation), there would be no mark up. The dealer had NO interaction me during the sales process and I think it’s unfair that they get a fee for just receiving the car.

1, I placed the order online. I had no contact with the dealer foe the initial reservation. They were just a dealer listed on the page.

2. I did not sign anything. All I did was the same standard online order we all did (above). No where in this process does it allow to elect for the x-plan.
When I started reading this forum, I realized that this $2k markup is not standard and not being charged by all dealers. Ford made this seem like this was a standard process across the board, just like ordering a Tesla. I contacted Ford, but was told that I could not switch dealers. I followed advice from here and signed up for the MCOA.
3. I included a picture of the order.

This dealer does not accept xplan. As stated earlier dealers are not required to accept xplan.

The adm was known to you when you actually placed the order. Before hitting the order button you had an opportunity to transfer your reservation to a non adm dealer and perhaps one that accepts xplan. That would’ve taken about 5 days. What you’re trying to do now is change the terms of the agreement you made with the dealer. Unfortunately, they’re not obligated to agree to change the terms.

So your choices are to pay the contracted for price and go home with the car you ordered and never do business with that dealer or anyone like them again. Or you can walk away if they don’t agree to sell at MSRP. If you choose the latter, you can reorder another Mach-e at a dealer that sells the car at MSRP or accepts XPlan. Or you can buy something else.

The only argument you might have versus this dealer is if, and only if, they actually accept xplan on other cars but not the Mach-e. That seems unlikely though.
