Omg! I made a mistake of ordering my Mach E through the same dealership! just checked with the sales director , this is the response I got:

He said there will be 5-10% ADM! guess I have to figure out how to get my deposit back now.
Ford Mustang Mach-E Dealership attempted markup and then sold my reserved MachE to someone else in under 48 hours 1665016511084

Frontier Ford and Sunnyvale Ford are both sleazy stealerships tacking on ADMs on previous orders.

There’s probably no legal action here, but it’s a serious black eye for Ford. Ford should make this right.

Oh man, they didn't enter the markup online then. It should show it on "Difference from Total MSRP". That's definitely grounds for breach of contract IMO.

Wonder what happens if you try to buy and sign for it online since they don't have the markup entered. Legally you could buy it for the price shown.

See if you can have your order moved to The Ford Store Morgan Hill. I’ve heard nothing but great things about them. I’m not exactly sure of the process to move an order, but I’ve read on the forum that others have done so successfully…

Oh man, I’m so sorry to hear this—it’s beyond infuriating! I agree with the other members, I wouldn’t let this go and contact the media etc. I’m an attorney in IL and teach law for a living nowadays—it doesn’t hurt to consult an attorney in your state to see if anything can be done (a lot of them should have a free consultation). Besides legal fees making it not worth suing, I think it will be hard to prove damages—but honestly it’s not my area of expertise. Everything happens for a reason man, hang in there.

Grt Ford Corporate leadership involved. Farley frowns on stuff like that. Pretty sure that won’t get you your car, but maybe they can put another order in as a priority and honor pricing at the time of original order. ??

This is probably the best outcome at this point I think

When Ford came out a couple of weeks ago telling dealers that by the end of this month they have to elect whether they’ll be a Model E dealer or not, it was primarily to deal with this issue. One of the requirements of going Model E is that the car must be sold at the agreed upon price at point of order, without any change or forced add-ons at point of delivery. Unfortunately, this will not become effective till 2024, but given how protected dealers are through state laws, I’ll be shocked if Farley actually gets it implemented. Until then, there’s really not a lot they can do.

FWIW, in California there are very strict rules about how dealers advertise ADM.

Unfortunately for the OP, without a signed buyers order with pricing, they absolutely can screw you over on the price.

What they CANNOT do is advertise one price and charge another.

You can turn them in to the BBB and go from there.

Edit:

Law details here:

That's awful. What really irks me about a situation like this is the dealer didn't have to do any work for this order. A customer ordered online on chose the dealer. The dealer accepts order and then it comes in. Then they screw over customer

For a car a dealer ordered in their own behalf, had to market, etc themselves I get charging an ADM on a vehicle in demand - that should be set by the market. Preying on someone that ordered at a specified price, with no indication upfront of a different price, and waited for 9 months and then screwing them is not at all acceptable. This model will weed itself out - good luck to all the dealers out there pulling this garbage.

My order placed 11/30/21 is due in next week. Is there anything I should do to prepare for something like this happening? I’m really sorry that this happened to you. But now I’m afraid it could happen to me. Should I ask the sales guy now if they are planning to charge me ADM? How can I keep them from selling my order to someone else? I was getting super excited but now I’m nervous.

About all you can do is to insist you get the dealer’s offer in writing. Whether they give that to you or not is anyone’s guess. A good dealer will go for it. A bad one won’t. ?‍♂?
