That's not what happened here. This was a car that was coming in for sale that OP put a deposit on directly with the dealer.
Ah, I misunderstood then! I thought he ordered it thru the website and the dealer sold it when it arrived.

I'm not saying he should or should not sue anybody. I was asking about the statement that he would never sue anybody.

This is where I got confused. I was thinking the poster ordered it through the Ford website. In that case, if it was just a handshake deal then good luck I guess. They probably do sell them to anyone who walks through the door first with the cash.

It does sort of defeat the purpose of a deposit if they'll just sell it out from under it.

Sheesh, the language on the site reads like a dealer doesn’t even have to refund the deposit. I wonder how many Ford dealers even have a written deposit policy?
The refund policy is very dealership specific. That's why everyone here recommends contacting the dealers to find out what their deposit policy is before placing an order. I have every intention of taking delivery once my car arrives, but there's always the possibility that some big financial event might happen that would ultimately prevent me from being able to add a ~50k loan to my name. Knowing I wouldn't be out $500 if that happens is important to me.

One dealers response when I asked if the deposit was refundable was: "Unfortunately the deposit is non-refundable. Once you place the deposit, it is expected for you to pick up the vehicle. The ability to pre-order allows you to reserve the vehicle for yourself, before anyone can purchase it." Thanks, but no thanks! You don't sell me a car, you don't get to keep my money... Simple as that.

This is the epitomy of low morality. I ordered a Premium, space white, space grey interior, rwd, ext range through my local dealer. They hemmed and hawed over x plan insisting it did not apply to MME. I was so tired of dealers trying to bate & switch me by telling me they had the car I wanted in stock, only to go (sometimes great distances) & find they had a Select, or standard range, AND wanted to charge $5 to 7k over MSRP.
I decided to forgo the xplan incentive if the dealer I ordered from refuses, but I will be damned if I will pay a penny over MSRP.
I am greatly disappointed over Ford's "dealers are independent" response. They don't seem to care about their customers. We all know the dealers are getting some dealer hold back, and prob other incentives, do they have to bend us over also? I'm meeting with my dealer tomorrow to discuss financing. I already have full financing from my bank and Ford finance, but will listen to him if he can offer lower interest. Other than that and I walk away and wait until Lexus finally comes out with an all electric SUV. I have a fully functional car I was not trading in anyway.
This is BS. How much are we supposed to accept b4 Ford steps in to reign in these dealers?

This does not fill me with confidence as I await my GT Performance to be built and delivered to Sunnyvale Ford towards the fall.
I doubt they would do it with an ordered vehicle like that. The OP put a deposit on an incoming dealer stock car and sounds like they accidentally sold it to someone else.

OP gave the dealer $500 in return for the dealer promising to sell him this particular Mach-e when it arrived.

While it’s true that the OP got his money back, he wasn’t made whole. He still has the expectation that he would have this car, an expectation he paid for.
Also, the dealer made money off the sale that the OP could have made. That’s ill-gotten gains that should be disgorged.

It’s too small a matter to sue on, in my opinion, but this might be something to look at small claims court about.
