Hard to blow over when you are on crack.1. No. DUI is not an abbreviation for Driving While Intoxicated. It’s driving under the influence.
2. Again no, they’re arrested because it’s alleged they were under the influence. Testing isn’t perfect. Car based breathalyzer machines are notoriously inaccurate. The ones at the station are only slightly more accurate. Field Sobriety tests aren’t designed to test your sobriety, they’re designed to give police officers grounds to back up their reason for pulling you over. Failure in those tests, regardless of reason, including artificial limbs and joints, gives probable cause for arrest.
3. The only test worthwhile is a blood sample done at a hospital.
Unless the test has been fully adjudicated, alleged is the only proper response.
I speculate the driver was totaled.
