You missed the point. You need to read past the I spilled the coffee on myself. She wasn’t even close to unique. Plus McD’s intentionally made the coffee far hotter than necessary for proper brewing. They had a long history of burn cases known by corporate management and had standing orders to ignore them all and keep making the coffee too hot.I studied that case up and down years ago.
There is a reason why it’s so commonly cited in the “ridiculous lawsuits” category:
Personal responsibility.
She admits she spilled coffee on herself. That should be the end of the story. Whether it was 170, 185 or 190 degrees…. It will burn you.
What’s next? Sue Kraft because they make me boil their mac n cheese and the boiling water burned me?
Sue a knife company for making their knives “too sharp?”
She misused the product (spilled it). Would be entirely different if McDs threw it at her.
Lawsuits like this are the reason why they have to print (don’t put on head) on plastic bags.
